Common questions
Lasting Powers of Attorney
A Lasting Power of Attorney (LPA) lets you appoint trusted people to make decisions on your behalf if you lose mental capacity. There are two types: one for property and financial affairs, and one for health and welfare. Both require registration with the Office of the Public Guardian.
How it works

Completing the forms
We prepare the LPA documents, guide you through signing, and arrange for a Certificate Provider to certify the forms.

Registration with the OPG
Once signed, you submit the LPA to the Office of the Public Guardian for registration. This currently takes around 8–10 weeks.

Every LPA requires a Certificate Provider — an independent person who confirms that the donor understands the document and is not being pressured into signing it. As a professional Certificate Provider, we can fulfil this role for LPAs prepared by other solicitors or advisers.
How it works

We meet with the donor independently to discuss the LPA and confirm they understand its implications.

Certification
We sign the certificate section of the LPA, confirming the donor has capacity and is acting of their own free will.

Completion
The certified LPA can then proceed to registration with the Office of the Public Guardian.
